Confidentiality & Non-Compete Agreement:

Intellectual property rights: By taking classes at Wild Spirit Aerial Arts, 1/42 William St Botany, you will be exposed to intellectual property. Wild Spirit Aerial Arts, class structure, movements, nomenclature and its content specifically including but not limited to which is taught and used in all aerial acrobatics (silks, lyra, trapeze) fitness classes or circus arts classes (hereafter referred to individually and collectively as “Wild Spirit Aerial Arts”) are protected by intellectual property rights and laws. By signing this confidentiality and non-compete agreement, you agree to use Wild Spirit Aerial Arts intellectual property, including choreography, syllabus solely within Wild Spirit Aerial Arts, for your personal and non-commercial use. No content may be instructed, photographed, videoed, published in print or on the internet, downloaded, copied, reproduced, transmitted, stored, sold, or otherwise distributed without the prior and express written consent of Wild Spirit Aerial Arts owner. No person affiliated with Wild Spirit Aerial Arts may use Wild Spirit Aerial Arts property for commercial purposes, either with a business competitor, or as a sole proprietor within a fifty (1 to 15) kilometer radius of Wild Spirit Aerial Arts location or contracted location.

IMPORTANT: I have read the confidentiality & non-compete agreement and I fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.

If the student decides to submit their signature electronically, the student must check the “I Agree” button below. By doing so, the student hereby consents and agrees that their use of a key pad, mouse or other device to check the “I Agree” button constitutes their “signature”, acceptance and agreement as if actually signed by the student in writing and has the same force and effect as a signature affixed by hand. Further, the student agrees the lack of a certification authority or other third party verification will not in any way affect the validity or enforce-ability of their signature or any resulting contract. Before checking the “I Accept” button, the student must type in the name of the person completing this form. If the student is under 18 their parent or guardian must type in the name of the student, and the parent/guardians name. Typing said parent/guardian’s name confirms that they are the parent/guardian of this student and have the legal ability to waive the above mentioned rights for the minor.

Medical Emergencies:

In any event of an accident or emergency I hereby authorise myself or my child to be transported to a hospital for medical treatment and I hold Wild Spirit Aerial Arts School of Aerial Arts and its representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of any injury sustained while participating at or for Wild Spirit Aerial Arts School of Aerial Arts.

NOTE: This policy is required. If you do not accept it, you will not be able to enrol this family into any classes or camps.

The parties agree that this agreement may be electronically signed. The parties agree that the electronic signatures appearing on this agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.

Adult Enrolment is on an auto pay weekly debit.

Adult enrolments in classes uses Swipe payment gateway which is Australian standards compliant.

Upon enrolment in a weekly autopay class, I am required to set up my “AutoPay” by inputting my credit card or Debit Card details which I can review and change at any time in the Student / Parent Portal.

The fees of my first calendar week (7days)’s worth of classes will be paid upon enrolment of each class, which means my fees will always be paid 1 week in advance.

My auto debits will occur each week

I will be debited on a continual basis until my request to cancel the enrolment is processed by Wild Spirit Aerial Arts Admin. This will be processed within five business days of getting the cancelation request. If any debit occurs past this time, you will be credited.

I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties. I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 30 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).

Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
